Summary: erphome.pl is a paid SaaS service for apartment owners. We offer a 14-day free trial with no credit card. After it ends, a subscription is required. You can cancel at any time. We take no commission on your guests' bookings.
§1. Definitions
- Provider means ERP HOME SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, with its registered office in Zduńska Wola (ul. Złota 43, 98-220 Zduńska Wola, Poland), entered in the register of entrepreneurs of the National Court Register under number 0001136400, NIP 8291755545, REGON 540097406, operator of the erphome.pl platform.
- Platform means the erphome.pl website together with the management panel and the reservation page.
- Service recipient / Customer means a natural or legal person who has concluded a contract for the provision of electronic services by registering an account.
- Account means individual access to the Platform protected by a login and password.
- Trial period means 14 days of free access to the full functionality of the Platform, counted from the date of registration.
- Subscription means the paid plan (monthly, 3-month, 6-month or annual) entitling the Customer to use the Platform after the trial period ends.
- Apartment means the Customer's accommodation property whose reservation page is created and served by the Platform.
- Guest means a third party visiting the Customer's reservation page and/or making a booking.
§2. General provisions
- These terms set out the rules for the provision of electronic services by the Provider through the erphome.pl Platform.
- Using the Platform constitutes acceptance of these terms.
- The terms are available free of charge at https://erphome.pl/regulamin in a form allowing them to be downloaded, saved and printed.
- Using the Platform requires a device with internet access and a web browser supporting JavaScript.
§3. Registration and account
- Registering an account is free and requires a name and surname, an email address and a password. Providing a phone number and tax identification number is optional.
- The Customer undertakes to provide true data. The account is opened solely for the Customer's own use.
- The password is confidential. The Customer is responsible for all actions taken using their account.
- One person or entity may hold one account. In justified cases the Provider may agree to exceptions.
- The Provider reserves the right to refuse registration or delete an account without giving reasons, in particular where these terms have been breached.
§4. Trial period
- Every newly registered Customer receives free access to the full functionality of the Platform for 14 days from the date of registration (the Trial period).
- No payment details are required during the Trial period.
- After the Trial period the account becomes inactive (suspended). The Customer's data and that of their apartments is retained for 60 days from suspension, after which it is permanently and automatically deleted.
- A subscription can be activated at any time before the Trial period ends, from the management panel.
§5. Subscription and payments
- After the Trial period ends, access to the Platform requires payment of a subscription in line with the current price list at https://erphome.pl/cennik.
- Available billing periods and discounts on the base plan:
- 1 month, no discount,
- 3 months, 5% discount,
- 6 months, 10% discount,
- 12 months, 20% discount.
- Optional extras available for a monthly surcharge (net prices):
- each apartment beyond the first two (the 3rd and subsequent), PLN 15.00/month,
- your own domain (instead of an erphome.pl subdomain), PLN 10.00/month.
- Prices are stated net; VAT of 23% is added to every amount.
- Payments are handled through external payment operators (Przelewy24, Stripe). The Provider does not store payment card data.
- A VAT invoice is issued within 7 days of the payment clearing and sent to the email address given at registration.
- Failure to pay on time results in suspension of access to the management panel. The reservation page may remain active for 7 days after the payment due date.
- The Provider reserves the right to change the price list on 30 days' notice for active monthly subscriptions.
§5a. Renewals and pro-rata settlement
- The subscription does not renew automatically. Renewal requires the Customer to make the payment themselves from the management panel.
- A new subscription period begins on the day after the currently paid period ends. If the Customer has no active subscription, the new period begins on the day of payment.
- On renewal, active optional extras (your own domain, additional apartments) are automatically included in the new subscription and added to the amount, with no need to order them again.
- Buying an optional extra (your own domain or a further apartment) during a running subscription period is settled pro rata: the Customer pays only for the time remaining to the end of the current period:
- for the incomplete current month, in proportion to the number of days remaining,
- for each subsequent full month, the full monthly rate for the extra.
- Discounts for a longer billing period (§5(2)) apply solely to the base plan fee. Extras bought pro rata are settled at full monthly rates, with no discount.
- Fees paid for a subscription and optional extras are not refundable for an unused period, subject to §8(3).
§6. Scope of services
- Within the subscription the Provider supplies:
- a hosted apartment reservation page at an address in the erphome.pl domain or the Customer's own domain,
- a panel for managing bookings, the gallery and settings,
- iCal calendar sync (Booking.com, Airbnb and others),
- Telegram notifications about new booking enquiries,
- handling of the booking form and storage of enquiry data.
- The Provider is not a party to contracts concluded between the Customer and Guests and is not responsible for how a booking proceeds or for payments made by Guests.
- Integration with online payment operators (Stripe, Przelewy24) is included in the base plan and works by the Customer supplying their own API keys. Guests' payments go directly to the Customer's bank account.
- The Provider aims to keep the Platform available at a level of 99% per month. Technical breaks are announced at least 24 hours in advance where possible.
§7. Customer obligations
- The Customer undertakes to:
- use the Platform in accordance with the law and good practice,
- not publish content that is unlawful, offensive or misleading,
- not share their account with third parties,
- inform the Provider without delay of any unauthorised access to the account.
- The Customer is the controller of the Guests' personal data collected through the booking form and is responsible for processing it in accordance with the GDPR.
- The Customer warrants that they hold the rights to the material they publish (photos, descriptions) and that it does not infringe the rights of third parties.
§7a. Entrustment of the processing of Guests' personal data
In respect of Guests' personal data (collected through the booking form and stored in the Customer's Account) the Customer is the data controller within the meaning of Art. 4(7) GDPR and the Provider is the processor within the meaning of Art. 4(8) GDPR. This section constitutes the data processing agreement referred to in Art. 28(3) GDPR and binds both parties from the date the Account is registered.
- Subject matter and nature of the processing. Hosting the reservation page and the enquiry form, storing booking data on the Platform servers, sending Guests emails relating to a booking (confirmations, reminders, review requests) and, if the Customer configures this function, passing the content of a booking enquiry to the Customer's Telegram app.
- Duration of the processing. For the life of the Customer's Account and, as regards backups, until they are removed on rotation in accordance with the schedule described in the privacy policy.
- Type of data and categories of data subjects. Name and surname, email address, phone number, message content, dates and number of people in the booking, relating to Guests submitting an enquiry or booking through the Customer's page. The Provider neither requires nor processes special categories of data (Art. 9 GDPR) for this purpose.
- The Provider undertakes to:
- process Guests' data solely for the purpose and to the extent necessary to provide the services described in §6, on the Customer's documented instruction, which consists in particular of the configuration of the Platform (apartment settings, form content, enabled integrations) and the provisions of these terms,
- ensure that persons authorised to process the data are bound by confidentiality,
- apply security measures appropriate to the risk in accordance with Art. 32 GDPR, described in detail in the privacy policy (TLS connection encryption, hashed passwords, restricted database access, backups),
- engage further processors (sub-processors) only from the list in paragraph 6 below, and inform the Customer of planned changes to that list with the notice applicable to changes of these terms (§11), giving the Customer the opportunity to object,
- assist the Customer (through Platform functions or by contact at [email protected]) in meeting obligations towards Guests under Art. 15 to 22 GDPR and in reporting personal data breaches to the supervisory authority (Art. 33 and 34 GDPR),
- inform the Customer of a breach of the security of Guests' personal data without delay and no later than within 48 hours of establishing it,
- delete or return all Guest data once the provision of processing-related services ends: this happens automatically when the Account is deleted (by the Customer or the Provider, in accordance with §8), unless EU or Polish law requires further retention,
- make available to the Customer the information necessary to demonstrate compliance with this section and allow inspection of the scope of processing, on the Customer's reasoned written request, at a time and in a form agreed with the Provider.
- The Customer is responsible for having their own legal basis for processing Guests' data and for meeting the information obligation towards them under Art. 13 GDPR (in accordance with §7(2) above). The Customer can download, export or delete booking data from the management panel at any time, which allows them to handle Guests' access, rectification and erasure requests themselves.
- Approved sub-processors. The Customer gives general consent to the Provider engaging the following further processors for the purposes described in paragraph 1:

§8. Termination and cancellation
- The Customer may cancel the subscription at any time from the panel or by email to [email protected].
- Cancellation of a monthly subscription takes effect at the end of the paid period. The remaining part of the fee is not refundable.
- Cancellation of an annual subscription before it ends: the Provider may (but is not obliged to) refund a proportionate part of the fee for unused full months, after deducting handling costs (a minimum of PLN 50).
- The Provider may terminate the contract with immediate effect in the event of a gross breach of these terms, in particular action to the detriment of Guests or the Provider.
- After the subscription ends (once the account is suspended) the Customer can download their booking data from the management panel. 60 days after suspension the account and all its data is permanently and automatically deleted.
§9. Liability
- The Provider is not liable for interruptions in access to the Platform caused by force majeure, failures of external infrastructure or the actions of third parties.
- The Provider's total liability towards the Customer for any single event is limited to the subscription fees paid by the Customer in the preceding 3 months.
- The Provider is not liable for the correct operation of external services (Booking.com, Airbnb, Stripe, Przelewy24, Telegram) or for changes to their APIs.
§10. Governing law and dispute resolution
- These terms are governed by Polish law.
- Any disputes will be settled amicably. Failing agreement, the court with jurisdiction is the court for the Provider's registered office.
- Customers who are consumers have the right to out-of-court dispute resolution (the ODR platform: https://ec.europa.eu/consumers/odr).
§11. Changes to the terms
- The Provider may change these terms, informing Customers by email at least 14 days in advance.
- No objection within 14 days of receiving the notification is treated as acceptance of the new terms.
- If the Customer objects, they may terminate the contract with effect at the end of the current billing period.
§12. Final provisions
- Matters not governed by these terms are subject to the provisions of the Polish Civil Code and the Act on the provision of electronic services.
- If any provision of these terms is or becomes invalid, the remaining provisions remain in force.
